Cunning,I'm glad I got a second chance to read this excellent post.
Do you have any remarks...I think I know the answer to that one!... on activist judges? We know of a case in which the jury unanimously found in favor of the defendent...but the judge overturned their verdict because he believed they made the wrong decision...

Krisles: It's definitely out of control, and I mean everything I said here. Anytime somebody has a chance to get something for nothing they're going to jump at it. Rewarding bad behavior could just be the fall of the great society. But I'll try to stay positive. Thank you very much for the thoughtful commentary and the nice review.

But, tell me, how do you really feel about all of this? Seriously, great post and I agree 1000% with every word - I just love to say that bit!!  People get so wound up with the concepts of lawsuits and free speech and all....I blame California for so much of it....the burgler who was awarded a rather tidy sum when he broke his arm falling through the skylight in the roof.....and the other one bitten by the guard dog...both are true stories.  And, the Dixie Chicks crying about free speech when exercising theirs elicited some bad response and backlash simply amazed me..... gee, did they forget that it's a two-way street? That seems to be happening a lot with the concept of free speech these days - it's seems too have evolved in lots of folks' mindset into this idea that they can get up and say anythng they want to say with no consequences.  It's all wrapped up in this consequences/responsibility....dare I say maturity maybe?...thing.  Eeeek! I'm blathering again......sorry!

CunningLinguist, I have never had a desire to sue anyone for anything because my parents taught me that it is against the Law (of God) to sue anyone who is another Christian.   And, you see, I can't tell the difference between who is and who isn't and sometimes their actions don't match their words.     Loved the post.

in that case, the ground is partially to blame.  If not for the ground, you would have had nothing to fall and hurt yourself on.  So we'll sue the ground.  On what grounds, I don't know.  We'll find something.

I will be filing a lawsuit against target because I dropped a water bottle on my toe last weekend and ended up with a really bad bruise.
