Now if that's the reason for him suing, that just doesn't seem like a strong case to me. Are business supposed to have bathroom monitors?

I think you nailed it...HD has much deeper pockets. Someone had asked why HD would be sued. It has nothing to do with whether or not the person would win. Consumers go after the pocketbook. Most often companies will settle with the consumer just to be done with the case and head off negative publicity.
Now in a sick way, it could be a serious PR campaign. It proves the glue they are selling works.

Actually, the way I heard it
he was suing because he had a heart condition, was yelling for help, and no one came to help him. Me? I would have just walked out with the seat glued to me. It's amazing how fast you get noticed and helped when you're bottomless.

That same guy allegedly made the same complaint about some public toilet ito some municpal worker - he got no cash.
Maybe HD has a deeper pocket.
Remember the lady who threw the finger into the chili at Wendy's, only to find out she got it off a relative?
I need to sue Hershey for making me fat.
