- Go to Kelo Supreme Court Decision: 2 Years Later
WavyDavy
The decision was unfortunate. Yet there are sometimes when progress is held up by one intransigent property owner, who for no rational conclusion, refuses to sell. This one party may render the project untenable. There has to be a way to convince that party to relent. I wish I could determine how such result could be achieved.
Because I am not as versed in the Constitution as The Supreme Court, it would be imprudent for me to say the decision was wrong. Maybe, that's where the Constitution leads. Nor was I there when the arguments were presented. Yet, it is reprehensible for any jurisdiction to conclude that it has the right to ride roughshod over its citizens.. How do we strike a fair balance, I do not know.

I know, I can't stand Trump, or those major corporations of which you speak!

When I was a tiny tot, my grandmother's property, which I dearly loved, was taken for a highway. I had no idea why, or what was happening. It was very traumatic for me.

Taps: It always seems that these ''needed highways, schools, hospitals, etc'' are right where you presently live. I bet that the people who have been victims of eminent domain decisions in the past think these same thoughts or state them verbally.

I don't like it at all. It was bad enough when the "confiscation" was for something like a needed highway.

Enigmatic68: I agree with you that it was one of the worst Supreme Court decisions of all time. Unfortunately, people like Donald Trump and major corporations have a tremendous amount of clout in the judicial system and with governments as well at all levels. Regarding Justice Souter, I heard about that as well. I don't believe that they succeeded. Supreme Court justices homes must be protected at all costs. This is an unwritten but enforced rule.

Hell, no. I remember some conservatives were trying to use that decision, to tear down the ulta-liberal, Justice Souter's home - but I never heard if they succeeded, or if it's still in the process - without a doubt, one of the worst Supreme Court decisions, of all time!
